VOTERS BEWARE
The wording of the ballot was intentionally crafted to be misleading. It has already been ruled unlawful.
Here are the FACTS:
1. A circuit court did rule the amendment process unlawful
In January 2026, a Tazewell County Circuit Court judge ruled that the way the General Assembly passed the proposed constitutional amendment was invalid and violated state law. The judge said lawmakers failed to follow required procedures for constitutional amendments.
The ruling focused mainly on the legislative process, including:
• Improperly expanding the scope of a special legislative session
• Not meeting required public notice timelines
• Passing the amendment while elections were already underway
Because of this, the judge initially blocked the referendum.
2. The Virginia Supreme Court allowed the vote to proceed anyway
The Virginia Supreme Court later stepped in and allowed the referendum process (including early voting) to go forward temporarily. However, it did not decide the final legality yet.
The court basically said:
• Voting can proceed for now.
• But the legality of the amendment and referendum will be decided later, after votes are counted.
So the election is still happening even though the results may later become invalid. 🤷‍♂️
3. The wording of the ballot question is being challenged
There are also lawsuits specifically attacking the ballot language crafted by far left Democrats in control of the state legislature, arguing that it is misleading because it says the amendment would “restore fairness.”
For example, the ballot question asks:
“Should the Constitution of Virginia be amended to allow the General Assembly to temporarily adopt new congressional districts to restore fairness in the upcoming elections while ensuring Virginia’s standard redistricting process resumes for all future redistricting after the 2030 census?”
Yes, that’s 4 YEARS from now. 😳
That “temporary” time will include all Congressional Mid Term Elections over those 4 years for United States Congress and Senate. And also the next elections for President, Governor, and State Delegates and Senators.
It’s a blatant sham being forced onto ALL VOTERS IN VIRGINIA.
Critics say wording like “restore fairness” is politically biased.🤔
But again:
• No final court ruling has declared the wording unconstitutional yet.
Bottom line
• A trial judge ruled the amendment process unlawful.
• The Virginia Supreme Court allowed the vote to continue anyway while it reviews the case.
• The wording is being challenged, but it has not been finally ruled unconstitutional.
